By using Upscale Print ("we," "us," "our"), operated by Bartosz Zyglowicz (NIP: 8381755810), Oginskiego 25, 96-300 Żyrardów, Poland, you agree to these Terms of Service. If you don't agree, please don't use our services.

2. Our Services

Upscale Print transforms your photos into gallery-quality wall art. We:

Accept your uploaded photos
Enhance them using AI technology
Print and frame them through our fulfillment partner
Ship them to your door

3. Your Account

Account creation

We create an account for you automatically when you place an order, using your email address.

Account access

We use magic links (emailed to you) instead of passwords. Keep your email secure.

Your responsibility

You're responsible for all activity under your account.

Choose size, frame, and finish
Enter shipping details
Complete payment via Stripe

Pricing

All prices are shown in your local currency and include the print cost. Shipping is calculated at checkout.

Payment

We use Stripe for secure payment processing. Your payment details are handled directly by Stripe.

5. Your Content

Your photos

You retain ownership of photos you upload.

License to us

By uploading, you grant us a license to:

Store your photo
Enhance it using our AI technology
Print it for your order
Display it in your order history

Your responsibility

You confirm that:

You own the photo or have permission to use it
The photo doesn't contain illegal content
The photo doesn't infringe anyone's rights

Content we may refuse

We reserve the right to refuse orders containing content that is illegal, infringes intellectual property, or depicts graphic violence or illegal activity.

6. Production and Fulfillment

Production partner

Your prints are produced by Prodigi, our fulfillment partner.

Production time

Most orders are produced within 2-5 business days.

Quality

Each print is inspected before shipping. We use archival-quality inks and materials.

7. Shipping and Delivery

Shipping times

Vary by destination. See our Shipping Policy for estimates.

Customs and duties

For international orders, you're responsible for any customs duties or import taxes.

Address accuracy

Please ensure your shipping address is correct. We're not responsible for delivery issues due to incorrect addresses.

8. Returns and Refunds

If you're not happy with your order, contact us within 30 days.

After production starts

Cancellation isn't possible once your order is in production.

10. Intellectual Property

Our content

Our website, branding, and technology are protected by intellectual property rights.

AI enhancement

The AI enhancement we apply becomes part of your ordered product. You may use your enhanced prints for personal purposes.

11. Limitation of Liability

To the maximum extent permitted by law:

We're not liable for indirect, incidental, or consequential damages
Our total liability is limited to the amount you paid for your order

This doesn't affect your statutory rights as a consumer.

12. Disputes

Governing law

These terms are governed by Polish law.

Dispute resolution

We encourage you to contact us first to resolve any issues. If we can't resolve it, disputes will be handled in Polish courts with jurisdiction in Żyrardów.
